General Terms and Conditions (GTC)

Welcome to Castashoot. These General Terms and Conditions (“GTC”) govern the use of the Castashoot platform, operated by tim3l3ss (sole proprietorship, owner: Timon Duodu), Libellenstrasse 15, 6004 Luzern, Switzerland (hereinafter “we”, “us”). By registering, you accept these GTC.

1. Subject matter and role of Castashoot

Castashoot is an online marketplace that brings together clients (“Brands”) and creative talent (models, photographers, make-up artists, stylists, videographers, crew, and others).

We merely facilitate the contact between users. We are not a party to the contracts, bookings or shoots concluded between them and assume no responsibility for their conclusion, content, execution, quality, payment or fulfilment. Agreements on services, fees, dates, usage rights and the like are concluded directly between the users involved.

2. Account and eligibility

Use is reserved for persons aged 18 and over. By registering, you confirm that you are of legal age and that you provide truthful information. You are responsible for keeping your access credentials confidential. As a rule, one account per person is permitted.

3. Subscriptions, prices and billing

Basic use is free of charge (“Free” plan). In addition, we offer paid subscriptions:

• Basic: $9.90 per month
• Pro: $19 per month
• Business: $49 per month

All subscriptions can be booked either monthly or annually. With annual billing we grant a discount of 17 % compared to monthly billing. The prices displayed at the time of booking are decisive.

3.1 Free trial period (14 days)

New paid subscriptions begin with a 14-day free trial period. To start the trial period, a valid payment method must be provided. No costs are incurred during the trial period. If you do not cancel before the 14 days expire, the subscription automatically becomes chargeable and the payment method provided is charged for the selected plan. As a rule, the trial period can only be used once per person/account.

3.2 Automatic renewal

Subscriptions renew automatically for the same period after the respective term (month or year) expires, until they are cancelled. Billing takes place at the beginning of each new period.

3.3 Payment processing via Stripe

Payment processing is handled by our payment service provider Stripe. We do not store any complete card data. Stripe’s terms additionally apply.

3.4 Cancellation

You can cancel your subscription at any time via the customer portal. A cancellation takes effect at the end of the term already paid for; until then you retain full access. Amounts already paid for the current period are not refunded on a pro-rata basis, unless mandatory law provides otherwise.

3.5 Downgrade

A switch to a cheaper plan (downgrade) takes effect at the beginning of the next billing period. Until then you retain the features of your previous plan.

3.6 Price changes

We may adjust the prices for future billing periods. We will inform you of price changes in good time before they take effect. If you do not agree with a change, you can cancel the subscription at the end of the current period.

4. Permitted use and prohibited content

You may not upload, share or distribute any content that:

• is nude, sexually explicit, pornographic or offensive;
• is unlawful, discriminatory, harassing, abusive or fraudulent;
• infringes the rights of third parties (copyright, trademark, personality rights);
• contains malware or impairs the security of the platform.

Our community guidelines apply in addition. We may moderate and remove content and block or delete accounts in the event of violations.

5. Verification badge

Certain accounts can receive a verification badge. The badge merely confirms that certain information has been checked by us. It is not a guarantee of the identity, qualifications, trustworthiness or capability of the respective users. We may revoke a badge at any time, in particular in the event of violations of these GTC.

6. Liability

We assume no warranty for the conclusion, content or fulfilment of the agreements concluded between users, nor for the content posted by users. Our liability is, to the extent legally permissible, limited to intent and gross negligence. Liability for injury to life, body and health, as well as under mandatory statutory provisions, remains unaffected.

7. Termination

You can delete your account at any time in the settings. We may block or delete accounts that violate these GTC.

8. Changes to the GTC

We may amend these GTC and will inform you of material changes. If you do not object within the notified period and continue to use the platform, the amended GTC are deemed to have been accepted.

9. Applicable law and place of jurisdiction

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is, to the extent legally permissible, [PLEASE COMPLETE: place of jurisdiction, e.g. Luzern, Switzerland]. Mandatory consumer protection provisions of the consumer’s country of residence (e.g. in Germany) remain unaffected.
